What is a New
York Construction Contract?
A New York construction contract is a written document that complies with New York
construction contract law. For example, a deck construction contract or a pool construction
contract must meet the requirements of New York General Business Law, Section 771.
Home improvement contracts, home repair contracts, contracts for construction of
custom homes and contracts for improvement or repair of leased residences must comply
with New York General Business Law Article 36-A. Even a minor technical violation
can result in a $100 penalty. For substantial violations, the penalty is the greater
of $250 or 5% of the contract price up to $2,500

How is New York

contractor be permitted to suspend work or terminate the contract? What constitutes
substantial completion? Will the contractor be permitted to collect the final payment
if discrepancies remain on the punch list?

Warranty: What's the duration of the warranty, if any? What constitutes a construction
defect? What repairs are required when a construction defect is found? Can the contractor
or subcontractor disclaim the implied warranties of habitability and workmanlike
construction?
